FURTHER ORDERED that the petition for writ of mandamus be denied. Petitioner has not shown that he has a clear and indisputable right to the extraordinary remedy of mandamus. See Allied Chem. Corp. v. Daiflon,Inc., 449 U.S. 33, 35 (1980).
