ORDERED and ADJUDGED that the judgment of the District Court appealed from in these causes be affirmed with respect to the grant of summary judgment on Count 1, and be vacated with respect to the Rule 11 sanctions award and remanded for the district court to consider whether to impose sanctions under its inherent authority, in accordance with the opinion of the court filed herein this date.
